HSDFI does not hold any production rights to the stage productions and, if agreed, will serve only as a Lessor to the Malco Stage Company. HSDFI, to the maximum extent permitted by applicable law, in no event shall be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of Malco Stage Company productions or related services to any subscriber, creditor or stakeholders related to, or affected by its services and productions.

It is further understood and agreed that the leasing of its facility is not to be construed as an admission of any liability and acceptance of assumption of responsibility by HSDFI, its officers, board, and employees, jointly and severally, for all damages and expenses for which the Malco Stage Company, its officers, board and employees, become liable as a result of any alleged act of their participants or audiences.
